CloudStorm

Terms of Service

Last updated 06 August 2026 · version 2

1. Who we are, and what you are agreeing to

CloudStorm is operated by SIX4 Technologies LLC, a Wyoming limited liability company, which is also registered to do business in Michigan. "CloudStorm" is a registered assumed name of that company. In these Terms, "we", "us" and "our" mean SIX4 Technologies trading as CloudStorm, and "you" means the person or organisation using the service.

These Terms govern your access to and use of CloudStorm — the website at oncloudstorm.com, the customer portal at app.oncloudstorm.com, the APIs behind them, and the services described below. By creating an account, ticking the box that says you accept these Terms, or using the service, you agree to them. If you do not agree, do not use CloudStorm.

You must be at least 18 years old. If you are accepting on behalf of a company or other organisation, you confirm you have authority to bind it, and "you" means that organisation.

Your use of CloudStorm is also governed by our Privacy Policy, which forms part of these Terms.

2. What CloudStorm provides

CloudStorm is a cloud platform made up of several product lines. They are at different stages, and these Terms apply to each one as it becomes available to you:

We may add, change, or withdraw product lines and features. Where a product line is described above as not yet available, nothing in these Terms is a commitment to release it, or to release it on any particular date or at any particular price.

3. Beta service

CloudStorm is currently in beta, and you should read this section carefully because it is the most important thing to understand about the service today.

Do not run anything on CloudStorm during the beta that you cannot afford to lose or to have interrupted.

4. Your account

4.1. You must give accurate, current and complete information when you register, and keep it up to date. We use the email address on your account for billing, service notices and security messages, so it needs to be one you actually read.

4.2. You are responsible for your account credentials and for everything that happens under your account. Enable two-factor authentication and keep your recovery codes somewhere safe.

4.3. Tell us immediately at [email protected] if you believe your account or credentials have been compromised.

4.4. You are responsible for the security of what you run on CloudStorm — operating-system patching, firewall rules, application security, and who you grant access to. We do not manage, monitor or secure the contents of your instances unless you have separately bought a managed service from us in writing.

4.5. You are responsible for the people you invite into your organisation and for what they do with the access you give them.

5. Fees and payment

5.1. Prices. CloudStorm is a paid service. You pay for the resources and products you provision, at the prices published at oncloudstorm.com/pricing or in a written order or quote we have given you. Where a written order and the published prices differ, the written order applies to you.

5.2. Currency. All prices, invoices and payments are in United States dollars.

5.3. What accrues. Charges run from the time a resource is provisioned until it is destroyed. Resources remain billable while an instance is powered off, because the underlying capacity stays reserved for you. To stop being charged for something, destroy it — do not just switch it off.

5.4. Changes to what you use. You may increase or decrease resources at any time. Changes are prorated and appear on your next invoice.

5.5. Payment method. Accounts are billed to a payment card by default, and you authorise us and our payment processor to charge it for all amounts due. Invoiced 30-day terms are available only where we have approved them in writing; they cannot be selected at sign-up.

5.6. Taxes. Prices exclude taxes. You are responsible for any sales, use, VAT, GST or similar taxes, other than taxes on our income.

5.7. Late or failed payment. If an undisputed invoice is more than 14 days past due, we may suspend your account. Suspension withholds the service; it does not delete your data, and it does not stop charges accruing on resources you still have provisioned. Once the outstanding balance is settled, service is restored.

5.8. Disputes. Raise any billing dispute in writing within 30 days of the invoice date. You must pay the undisputed part of an invoice while we look into the rest.

5.9. Refunds. Fees are non-refundable except where we decide otherwise or the law requires it. There is no self-service refund. If you think you have been charged in error, email [email protected].

6. Your content, and credentials you give us

6.1. You keep your content. Everything you store, upload, run or create on CloudStorm — data, code, configuration, agent instructions and prompts, and anything your users put in — stays yours. We claim no ownership of it.

6.2. The licence we need. You grant us a limited, non-exclusive licence to host, store, copy, transmit and process your content strictly as needed to operate the service for you, to keep it secure, and to provide support you ask for. Nothing more.

6.3. You are responsible for your content — that you have the rights to it, that it does not infringe anyone else's rights, and that handling it does not break the law. If you put personal data belonging to other people onto CloudStorm, you are responsible for having a lawful basis to do so and for telling those people what you need to tell them.

6.4. Credentials you connect. CloudStorm lets you connect your own accounts with other providers — AI providers, source-control hosts, messaging and storage services and so on — by giving us an API key or token. Those credentials are encrypted before storage, are never displayed back to anyone including our own staff, and are decrypted only in the moment we need them to reach the provider you named. Even so, you supply them at your own risk, you should scope them to the minimum access they need, and you should revoke them at the provider if you stop using CloudStorm.

6.5. Your relationship with those providers is yours. Your use of a connected third-party service is governed by that provider's terms, and you pay that provider directly for what you consume. We are not a party to that arrangement and are not responsible for their service, their pricing, their availability, or what they do with the requests we send on your instruction.

7. AI features

7.1. CloudStorm includes AI agents and AI-assisted features. AI output can be wrong, incomplete, biased or misleading, and can look confident while being none of those things. You must review AI output before relying on it, and you must not treat it as legal, financial, medical or other professional advice.

7.2. You are responsible for what agents do under your account. When you give an agent a task, credentials, repository access, or the ability to run commands, you are accountable for the results as if you had done it yourself. Give agents the narrowest access that lets them do the job, and review their work.

7.3. We do not use your content to train AI models. Where a feature sends your input to a third-party AI provider, it goes to the provider you connected, under that provider's terms.

8. Acceptable use

8.1. You must not use CloudStorm, or let anyone else use it, to host, store, transmit, generate or support any of the following:

8.2. You must not attempt to break, probe or circumvent the security of CloudStorm itself, interfere with other customers' use of it, resell access in a way we have not agreed to, or use the service in a way that degrades it for anyone else.

8.3. Enforcement. We may investigate suspected breaches and may suspend or terminate service, with or without notice, for activity that breaks this section or that puts our infrastructure, our other customers or third parties at risk. Where it is practical and lawful to do so, we will tell you first and give you a chance to fix it.

8.4. Reporting abuse. Report suspected abuse of CloudStorm to [email protected].

9. Availability and maintenance

9.1. There is no uptime commitment. We do not offer a service-level agreement, an uptime target, or service credits for downtime. We work to keep CloudStorm running and we monitor it continuously, but we make no promise about availability and you should not build on the assumption of one.

9.2. The service may be unavailable for planned maintenance, emergency maintenance, or reasons outside our control. Where maintenance affects infrastructure your instances sit on, we show it in the customer portal. We do not commit to a minimum notice period.

9.3. CloudStorm depends on other providers — data centres, network carriers, power, and the third-party services listed in our Privacy Policy. We are not liable for outages that originate with them and are beyond our reasonable control.

10. Backups, redundancy, and data loss

10.1. Backing up your data is your responsibility. You are solely responsible for the backup, retention and recoverability of everything you store on or process through CloudStorm, and for keeping copies somewhere that does not depend on us.

10.2. Standard storage is not a backup. Unless you have separately bought a redundant or replicated storage tier in writing, standard instance storage is not guaranteed to survive hardware failure, host failure, or any other loss event.

10.3. Optional protection. Where we offer snapshots, scheduled backups or replicated storage, they are chargeable options you choose and configure. Their availability does not move responsibility for your data from you to us, and buying them is not a guarantee that a given recovery will succeed.

10.4. No warranty that data survives. Except where we have given a written commitment in a separately purchased service, we do not warrant that your data will be preserved, and we are not liable for its loss, corruption or unrecoverability, whatever the cause — hardware failure, software failure, your own configuration or actions, a third party, or termination of the service.

10.5. Data after termination. When an instance or an account is terminated, the data associated with it may be permanently deleted. Retrieve anything you want to keep before termination takes effect.

11. Suspension, cancellation and termination

11.1. Ending your account. You may stop using CloudStorm at any time. An owner or administrator of your organisation can close the account from My Profile → Danger Zone in the customer portal; we will ask for your password and a two-factor code to confirm it is you. Closing the account ends access for everyone in your organisation immediately. Fees already incurred remain payable and are not refunded (section 5.9). If you cannot reach the portal, email [email protected] from the address on the account. You remain responsible for charges accrued up to the date closure takes effect.

11.2. Suspension by us. We may suspend your account, in whole or in part, for non-payment as described in section 5.7, for a breach of section 8, for activity that threatens the security, integrity or performance of the service, or where the law requires it. A suspended account keeps its data.

11.3. Dormant accounts. We may cancel an account that has been inactive for an extended period — broadly, no payments, no running resources and no sign-ins for around 90 days. We will try to contact you first, but we do not guarantee advance notice.

11.4. Termination by us. We may terminate these Terms and your access for material breach that is not fixed within a reasonable time after we tell you about it, or immediately where the breach is serious or the law requires it.

11.5. What termination means. Your right to use CloudStorm ends, outstanding fees become payable, and your data may be deleted as described in section 10.5. Sections 6.3, 10, 12, 14, 15, 16, 18 and 19 survive.

12. Intellectual property

12.1. We keep all rights in CloudStorm itself — the software, the infrastructure, the interfaces, the documentation, and the CloudStorm and SIX4 names and logos. These Terms give you the right to use the service; they do not give you a licence to our trademarks or our technology beyond that.

12.2. If you send us feedback, suggestions or feature requests, we may use them without owing you anything and without restriction. You do not have to send us any.

13. Privacy

How we handle personal data is set out in the Privacy Policy, which is part of these Terms. It describes what we collect, who we share it with, where it is stored, and how to ask us to change or delete it.

14. Disclaimers

14.1. CLOUDSTORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

14.2. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT ANY DEFECT WILL BE CORRECTED, OR THAT DATA WILL BE PRESERVED OR RECOVERABLE.

14.3. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

15. Limitation of liability

15.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, EVEN IF WE HAVE BEEN ADVISED THAT SUCH LOSS WAS POSSIBLE.

15.2. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO CLOUDSTORM OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.

15.3. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY — CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE — AND APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

15.4. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply to the fullest extent the law allows, and nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence.

16. Indemnification

You agree to defend, indemnify and hold harmless SIX4 Technologies LLC, its members, officers, employees and agents from any claim, damage, loss, liability, cost or expense (including reasonable legal fees) arising out of or relating to: (a) your use of CloudStorm; (b) your content or the content of your users; (c) credentials you connected and what was done with them; (d) your breach of these Terms or of section 8; or (e) your violation of any law or of anyone else's rights.

17. Changes to these Terms and to prices

17.1. We may change these Terms or our prices. For a material change, we will give at least 30 days' notice by email to the address on your account or through the customer portal, and we will update the "Last updated" date on this page.

17.2. Continuing to use CloudStorm after a change takes effect means you accept it. If you do not accept a change, your remedy is to stop using the service and close your account before the change takes effect.

17.3. When you sign up we record which version of these Terms you accepted, so there is a durable record of what you agreed to.

18. Governing law and disputes

18.1. These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18.2. Any dispute arising out of or relating to these Terms or to CloudStorm must be brought exclusively in the state or federal courts located in Oakland County, Michigan, and both parties consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

18.3. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

18.4. Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred, except where a longer period is required by law.

19. General

19.1. Entire agreement. These Terms, the Privacy Policy, and any written order or quote we have both agreed to, are the entire agreement between us and replace anything said or written beforehand on the same subject.

19.2. Order of precedence. If a signed written order conflicts with these Terms, the order wins for that customer, on that subject.

19.3. Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.

19.4. No waiver. Not enforcing a provision once does not waive the right to enforce it later.

19.5. Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.

19.6. Force majeure. Neither party is liable for a failure to perform caused by something outside its reasonable control, other than the obligation to pay money already owed.

19.7. Relationship. Nothing here creates a partnership, joint venture, employment or agency relationship between us.

19.8. Notices. Legal notices to us must be sent to the address in section 20. Notices to you go to the email address on your account, and are treated as received when sent.
